Until now, Romania had no body authorised by law to check how funds received as sponsorship and patronage are spent by recipients, in terms of compliance with Law no. 32/1994 on sponsorship. Under a recent government ordinance, the Ministry of Public Finance becomes the body with control responsibilities, through its own economic and financial inspection apparatus.
Legal framework
Government Ordinance no. 18/2018 on regulating certain measures in the field of economic and financial inspection carried out by the Ministry of Public Finance and on supplementing certain legislative acts was published in the Official Gazette no. 755 of 31 August 2018.
The new rules clarify how checks will be carried out on the use of sums and material goods received by NGOs, associations and foundations, or through sponsorship and patronage. The checks are assigned to the economic and financial inspection apparatus of the Ministry of Public Finance and ANAF (National Agency for Fiscal Administration).
The ordinance amends Law no. 32/1994 on sponsorship, Government Ordinance no. 26/2000 on associations and foundations, and Law no. 227/2015 on the Fiscal Code.
